Philip is developing a broad civil and criminal practice and accepts instructions in all areas of Chambers’ work. He has conducted legal proceedings (either on his own or led as a junior) in the Magistrates’ Courts, District Court and Court of First Instance in a wide range of different criminal and civil matters.

NOTABLE CASES & WORK:

Criminal

HKSAR v. Chan Siu Tan (FAMC 48/2019) – Philip was led by Edwin Choy S.C. to represent Chan Siu Tan, who was charged with Assault Occasioning Actual Bodily Harm and Common Assault in the Court of Final Appeal regarding the admissibility of video recorded material.

HKSAR v. Leung Wing-hei ([2021] HKDC 9, DCCC 493/2019) – Philip with Jonathan Lin (Senior Public Prosecutor as he then was) was led by Edwin Choy SC and prosecuted this fraud and money laundering case (allegedly involving over US$10 million) in the District Court of Hong Kong. It is the first case in Hong Kong history relating to crypto-currency, namely, Bitcoin.

HKSAR v. CKY (DCCC 623/2019) – Philip with Benny Lo was led by Edwin Choy S.C.in representing the Defendant in a District Court criminal trial relating to theft and use of a copy of false instrument regarding a notable musician.

HKSAR v. LKW (ESCC721/2023) – Philip was led by Edwin Choy S.C. in representing the Defendant, who was charged with inflicting grievous bodily harm. The Defendant was acquitted after trial.

HKSAR v. YJ (ESCC 1660/2019) – Philip was led by Edwin Choy S.C., in representing the Defendant, who was charged with wounding. The Defendant was acquitted after trial.

林徵嫦 訴 程練傳 (STSS 58720/2021) – Philip was led by Edwin Choy S.C in representing the Applicant against the Defendant in a Private Prosecution matter concerning 10 counts of theft.

香港特別行政區 訴 黃及另一人 (ESCC 613/2022) – (as sole advocate) appeared for one of the Defendants charged with Behaving in Disorderly Manner in a Public Place. The Defendant was acquitted after trial.

香港特別行政區 訴 黃 (KTCC 1844/2021) – Philip (as sole advocate) appeared for the Defendant who was charged with Indecent Assault of an Instagram KOL in a gym room. The Defendant was acquitted after trial.

香港特別行政區 訴 劉 (STCC 3718/2021) – Philip (as sole advocate) appeared for the Defendant who was charged with Assaulting a Police Officer. The Defendant was acquitted after trial.

香港特別行政區 訴 黃 (WKCC 3862/2021) – Philip (as sole advocate) appeared for Mr. Wong who was charged with Assault Occasioning Bodily Harm to a security guard of the Immigration Department. Mr. Wong was acquitted after trial.

Regulatory

Cardinalasia Consulting Limited v. Securities and Futures Commission (SFAT 2/2021) – Philip was led by Edwin Choy S.C.to represented the applicants in an application for review of the Securities and Futures Commission’s decision of culpability and the reasonableness of the sanctions imposed.

Civil

The Incorporated Owners Of Mei Foo Sun Chuen – Stage VI v. Billion Happy Investment Limited & Another (LDBM 155/2018) – Philip (as sole advocate) represented the incorporated owners and successfully obtained a mandatory injunction against the tenant in contravention of the Deed of Mutual Covenant in the Lands Tribunal.

Re: Tenancy Agreement in respect of a flat in Residence of Bel-Air, Philip represented the landlord of a residential unit in the Residence of Bel-Air and successfully obtained an order for vacant possession and arrears of rent and mesne profits from the tenant.
