Profile 簡歷:

Franco joined the Department of Justice, Prosecutions Divisions in 2005. He was promoted to Senior Public Prosecutor in 2011 and in 2015 became the Deputy Section Head of the Higher Courts Appeals and the Magistracy Courts Appeals.

關百安大律師於2005年加入律政司刑事檢控科,於2011年晉升為高級檢控官,並且在2015年成為高級法院上訴及裁判處上訴組副隊長。

During his 15-year tenure at the DoJ, Franco prosecuted hundreds of Court of First Instance and District Court cases, 200-odd Court of Appeal/Court of Final Appeal cases, and more than 300 Magistracy Appeals. Franco has also provided legal advice on over a thousand cases. His cases to date cover a wide spectrum of offences across all levels of court, ranging from commercial crimes, money laundering and industrial summons, to serious crimes such as possession of firearms, rape and homicide (including securing the overturn of Prof. Khaw Kim Sun’s homicide convictions at the Court of Final Appeal, i.e. the “Yoga Ball Murder” case).

在任律政司十五年間,關大律師著手檢控數以百計的高等法院及區域法院案件。刑事上訴方面,關大律師處理了二百多宗上訴法庭和終審法院的上訴及三百多宗裁判法院上訴,亦就超過一千件案件提供法律意見。他在任律政司及其後私人執業所處理的案件涵括商業詐騙、「洗黑錢」、工業安全等白領罪行,及眾多嚴重罪行,例如藏械、販毒、強姦及謀殺等(包括在終審法院成功推翻許金山教授兩項謀殺定罪- “瑜伽球命案”)。

Shortly before Franco left the DoJ in 2020, he had been the Senior Assistant Director of Public Prosecutions (Ag.) of the Magistracy Appeals, Case Stated and s.104 Reviews Section.

關大律師於2020年離開律政司。離開前曾為「裁判法院上訴,案件呈述及裁判法院覆核組」的署理高級副刑事檢控專員。

In addition to his legal practice, Franco is also a seasoned advocacy trainer teaching at the University of Hong Kong (PCLL) and also for the Bar at the Hong Kong Advocacy Training Council. Beyond the law, Franco is an avid chess player and marathon runner.

除上庭以外,關大律師在法學教授方面亦富有經驗。他在香港大學的法學專業證書課程中任教刑事訟辯技巧,亦為大律師公會高級法律進修課程擔任訟辯導師。法律之外,關大律師亦熱衷於下棋及馬拉松。

In terms of public appointment, Franco is currently the Honorary Legal Advisor of the Hong Kong Anti-Doping Committee established by the Sports Federation & Olympic Committee of Hong Kong, China.  Franco was also appointed as a deputy magistrate in 2021 and 2022, trying all sorts of criminal and summons cases in the Western Magistrates’ Courts and Kowloon City Magistrates’ Courts, including ICAC cases, fraud and listed/private company summons cases.

公職方面,關大律師亦擔任中國香港體育協會暨奧林匹克委員會所設立的香港運動禁毒委員會名譽法律顧問。他亦在2021及2022年被司法機構任命為暫委裁判官,在西九龍及九龍城裁判法院審理各類刑事和傳票案件,包括廉政公署案件,欺詐及有關私人及上市公司的傳票案件。
